Rosebud Man Charged with Drug User in Possession of a Firearm

United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man has been indicted by a federal grand jury for Drug User in Possession of a Firearm.

David John Kills In Water, age 27, was indicted by a federal grand jury on March 13, 2012. He appeared before United States Magistrate Judge Mark A. Moreno on March 30, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years of custody, a $250,000 fine, or both.
The charge is merely an accusation, and Kills In Water is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Rosebud Sioux Tribe Police Department, the Northern Plains Safe Trails Drug Enforcement Task Force, and the Bureau of Alcohol, Tobacco, Firearms & Explosives. The case is being prosecuted by Assistant United States Attorney Jay Miller. Kills In Water was released on bond with conditions. A trial date has been scheduled for May 21, 2012.
